These Terms of Service ("Terms") govern your use of website design, development, and related services provided by Mako Digital ("we", "us", "our"). By engaging our services, you ("client", "you") agree to these Terms.
We provide website design, website development, custom CRM/platform development, SEO services, and website hosting. The specific scope of work will be agreed in writing (via email or proposal) before any project begins.
Important: A 50% deposit is required before any work begins. The remaining 50% is due upon completion, before the website is released to you or made live.
We accept bank transfer (BACS) and card payments. Payment details will be provided on your invoice.
If payment is not received within 14 days of the due date, we reserve the right to suspend or take down any live websites and charge interest at 4% above the Bank of England base rate.
Additional revisions beyond the included rounds will be charged at our standard hourly rate (currently £50/hour). We will notify you before any additional charges are incurred.
Requests for work outside the original agreed scope (new features, additional pages, significant design changes) will be quoted separately and may affect delivery timelines.
You are responsible for ensuring all content you provide is legally compliant, does not infringe copyright or trademarks, and is appropriate for publication.
We reserve the right to cancel a project if payment terms are not met, if you fail to provide required content after reasonable requests, or if continuing the project would be unlawful or unethical. In such cases, you will be refunded for work not yet completed.
Until full payment is received, all work remains our intellectual property. You may not use, copy, or distribute any designs or code until payment is complete.
Website design/development is a one-off service. Hosting and maintenance are separate ongoing services with their own terms and pricing.
SSL certificate, daily backups, security updates, WordPress core updates, performance monitoring, and minor content changes (text/image swaps).
New pages, new features, design changes, plugin additions, or significant development work. These are quoted separately.
We warrant that work will be completed with reasonable skill and care, and will match the agreed specification. We offer a 30-day bug fix period after launch for any issues caused by our work.
You are responsible for backing up your own content, maintaining your own login credentials, and ensuring your website complies with applicable laws (GDPR, cookie consent, etc.).
We will keep your business information confidential and will not share it with third parties except as necessary to complete your project (e.g., domain registrars, hosting providers). This obligation survives the end of our business relationship.
If a dispute arises, we will first attempt to resolve it through good-faith negotiation. If we cannot reach agreement, disputes will be resolved under English law in the courts of England and Wales.
We may update these Terms from time to time. The current version will always be available on our website. Existing projects will be governed by the Terms in place when the project was agreed.
